The contract that's broken is between the seller and eBay, but like it's been said, that would be very hard to enforce/prove/etc. It's sad that some people don't see value or honor in doing things by the established rules and doing what they say they're going to do. As far as I can tell, most members of this group are just as much more honorable than average people as they are more intelligent/generous/supportive in my experience. But when it comes to the unethical 'there's one born every minute' types in the world, there are a lot more of them than there are of us.
